Hire Terms

Hire Terms and Conditions

 

1. INTERPRETATION

 

1.1 In these conditions, the following terms are defined as follows: "Contract" refers to an agreement incorporating these conditions, established between the Customer and the Supplier for the hire or sale of Goods.

 

"Customer" denotes the individual, firm, company, or other entity that hires Hire Goods or purchases Sale Goods.

 

"Deposit" signifies any advance payment the Supplier requires concerning the Hire Goods, held as security by the Supplier.

 

"Force Majeure" encompasses any event beyond a party's reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, subcontractors, lock-outs, riots, civil unrest, malicious damage, explosions, terrorism, government actions, and any similar occurrences.

 

"Goods" refers to any machine, article, tool, and/or device, along with any specified accessories in a Contract, that are hired or sold to the Customer.

 

"Hire Goods" are the Goods that are hired out to the Customer.

 

"Hire Period" is the duration starting when the Customer takes possession of the Hire Goods on hire (inclusive of Saturdays, Sundays, and Bank Holidays) and concludes with either (i) the Customer physically returning the Hire Goods to the Supplier's possession, or (ii) the Supplier physically repossessing or collecting the Hire Goods.

 

"Liability" encompasses responsibility for all forms of damages, claims, proceedings, actions, awards, expenses, costs, and any other losses and/or liabilities.

 

"Sale Goods" are the Goods that are sold to the Customer.

 

"Rental" is the rate at which the Supplier charges for the hire of the Hire Goods, as it varies over the Hire Period.

 

"Services" entail the services and/or work (if any) performed by the Supplier for the Customer in relation to the hire or sale of Goods, including any delivery and/or collection service for the Goods.
